Terms of Service for Reflectary App (Beta Phase)

1. Acceptance of Terms

By accessing or using the Reflectary app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use or access the app.

2. Description of Service

Reflectary is an AI-powered journaling app that allows users to create and maintain a digital journal. Features include AI-generated content, voice-to-text transcription, customizable writing styles, and secure journal storage.

3. User Accounts

To use Reflectary, you must create an account. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account.

4. User Conduct

You agree to use Reflectary only for lawful purposes. You are responsible for all content you upload or input into the app, including compliance with applicable laws, and you agree not to upload harmful or illegal content.

5. Intellectual Property

Reflectary, its contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design and arrangement thereof) are owned by Reflectary, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

6. User Generated Content

You retain all rights to the text you input into Reflectary. However, by using the app, you grant us a license to use this content for providing the services offered by Reflectary, including AI-generated journal entries.

7. Third-Party Services

Reflectary utilizes various third-party services, including Firebase, Sentry, and OpenAI API, to provide certain functionalities. Your use of Reflectary acknowledges that these services are integral to its operation.

8. Privacy

Your use of Reflectary is also governed by our Privacy Policy, which outlines how we handle data collected from you.

9. Modifications to the Service

We reserve the right to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

11. Disclaimers

The service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

In no event will Reflectary, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 15 days' notice prior to any new terms taking effect.
